Take to Table – End User Terms of Use (United Kingdom)

1. ABOUT THESE TERMS

1.1 These terms of use, including any documents they link to (“Terms”), are a contract between you (“you”, “your”, “User” or “End User”) and LOKE Mobile Limited, a company registered in England and Wales with company number 11252565 whose registered office is at Avenue HQ, 17 Mann Island, Liverpool L3 1BP (“LOKE”, “we”, “us” or “our”). By accessing or using the LOKE Take to Table Solution or the Platform you accept these Terms. If you do not agree to them, please do not use the Take to Table Solution.

1.2 The LOKE Take to Table Solution allows End Users at a Venue to order food, drinks and other concessions from a Food and Beverage Partner, which may be delivered to the End User at the Venue or collected from the Food and Beverage Partner (“Take to Table Solution”). The LOKE website at https://loke.global/ or any other website or application through which LOKE makes its products or services available (collectively, the “Site”) and any interaction with you via the Site or Take to Table Solution is referred to as a “Service”. In these Terms, the Take to Table Solution or Site as appropriate are referred to as the “Platform”.

1.3 LOKE collects personal data from you in the course of providing you with access to the Platform. Our Privacy and Cookie Policy for your region, available on our website at www.loke.global, explains what we collect, why, who we share it with (including the Venue Partner and the Food and Beverage Partner) and the rights you have. The Venue Partner and the Food and Beverage Partner also collect and use your personal data for their own purposes under their own privacy notices.

2. DEFINITIONS AND INTERPRETATION

2.1 Unless otherwise provided, in these Terms:

(a) ‘Intellectual Property Rights’ or ‘IPR’ means all intellectual property rights, including but not limited to, the following rights:

(i) patents, copyright, database rights, rights in designs, moral rights, trade and service marks (including goodwill in those marks), domain names and trade names and any right to have confidential information kept confidential;

(ii) any application or right to apply for registration of any of the rights referred to in paragraph (i); and

(iii) all rights of a similar nature to any of the rights in paragraph (i) which may subsist anywhere in the world, whether or not such rights are registered or capable of being registered.

(b) ‘Personal Data’ has the meaning given by the UK GDPR and the Data Protection Act 2018.

(c) ‘Personnel’ means the officers, employees, contractors (including subcontractors and their employees) and agents of LOKE, any LOKE group company, a Venue Partner or a Food and Beverage Partner.

(d) ‘Third Party Service’ means any third party software, application or website which the Platform directly or indirectly interacts with, including payment processors, point-of-sale systems and delivery providers.

(e) ‘User’ or ‘End User’ means any person who accesses the Platform.

(f) ‘Food and Beverage Partner’ means the business that offers food, beverages or other concessions for sale and collection or delivery to End Users through the Platform, and whose name appears against the items you order.

(g) ‘Venue Partner’ means the business that owns or operates the Venue.

(h) ‘Venue’ means the venue at which the End User accesses the Take to Table Solution, orders, consumes or takes delivery of food, beverages or other concessions from a Food and Beverage Partner.

(i) ‘Take to Table Solution’ means LOKE’s “Take to Table” solution which allows End Users to order food, drinks and other concessions from a Food and Beverage Partner which may be delivered to the End User at the Venue or collected from the Food and Beverage Partner.

(j) ‘Consumer’ means an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession.

3. LOKE

(a) LOKE owns and operates the LOKE Take to Table Solution and Site, and provides the Take to Table Solution under contract with the Venue Partner and the Food and Beverage Partners.

(b) By clicking “I Agree” and/or by accessing and/or using the Platform (whichever is first), the User will be bound by these Terms as they appear on the Platform from time to time.

(c) LOKE may amend the Take to Table Solution (including any of its functionality) and these Terms from time to time, for example to reflect changes in law, changes made by a Third Party Service, or improvements to the Take to Table Solution. We will give you reasonable notice of any material change to these Terms by posting the updated Terms on the Platform and, where we have your contact details and the change is significant, by notifying you directly. If you do not agree to a change you may stop using the Take to Table Solution at any time. Your continued use of the Take to Table Solution after a change takes effect will constitute acceptance of the amended Terms.

4. REGISTRATION

(a) The User acknowledges and agrees that:

(i) it can use some aspects of the LOKE Take to Table Solution without registration with LOKE; but

(ii) to use all functionality of the LOKE Take to Table Solution it may need to register and provide to LOKE all information required by LOKE during the registration process (User Information) via the LOKE Take to Table Solution or a nominated website.

(b) By registering and providing the User Information, the User confirms that:

(i) it will provide up-to-date, current and accurate information and will update its User Information as required;

(ii) it will keep the registration details, including username(s) and password(s), secure and confidential, and will tell us promptly if it believes its account has been used without authority; and

(iii) the User Information is not misleading, false, fraudulent or defamatory and does not infringe the Intellectual Property Rights or privacy rights of any third party.

(c) You must be at least 13 years old to register for an account. Where a Food and Beverage Partner sells age-restricted products such as alcohol, you must be at least 18 years old to order them, and the Food and Beverage Partner or Venue Partner may ask for proof of age before handing them over and may refuse to serve you in accordance with the Venue’s licensing conditions.

5. ORDERS, PAYMENT AND DELIVERY TO YOUR TABLE

(a) When you place an order through the Take to Table Solution, your contract for the food, drinks and other concessions ordered is with the Food and Beverage Partner, not with LOKE or the Venue Partner. The Food and Beverage Partner is responsible for accepting your order, preparing and supplying the items, and for their quality and description. An order is accepted when the Food and Beverage Partner confirms it in the Platform.

(b) Payment for orders is collected through the Platform by our payment processor (currently Stripe) and paid to the Food and Beverage Partner. We do not hold your money. Where a platform, service or delivery fee is charged for using the Take to Table Solution it will be shown to you before you confirm your order.

(c) You must enter your correct seat, table or collection point when ordering. Delivery to your location at the Venue is carried out by the Food and Beverage Partner or the Venue Partner’s staff; LOKE does not deliver orders. Delivery and collection times shown in the Platform are estimates and may be affected by demand at the Venue, and neither LOKE nor the Venue Partner is responsible for delays caused by incorrect location details, Venue security or access restrictions, or the End User not being at the stated location when the order arrives. Where an order is for collection, you are responsible for collecting it from the point and within the time shown in the Platform.

(d) Because food and drink are perishable and prepared to order, you do not have a statutory right to cancel an order once the Food and Beverage Partner has accepted it. If something is wrong with your order, you are entitled to the remedies set out in the Consumer Rights Act 2015 from the Food and Beverage Partner, and the Food and Beverage Partner may issue a refund through the Platform.

(e) Any loyalty points, rewards, vouchers or credit offered through the Take to Table Solution are issued by the Venue Partner or the Food and Beverage Partner, can only be used in accordance with the programme rules shown in the Platform, have no cash value, cannot be transferred or sold, and may expire or be withdrawn in accordance with those rules.

6. FRAUD, RISK AND ACCEPTABLE USE

(a) LOKE reserves the right to restrict or suspend use of the LOKE Take to Table Solution if LOKE reasonably suspects fraud, a breach of these Terms, or if LOKE otherwise reasonably believes there is a risk to us, you, a Venue Partner, a Food and Beverage Partner or any LOKE user. We will tell you why, unless doing so would be unlawful or would prejudice an investigation.

(b) You authorise us to make, directly or through third parties, any enquiries we reasonably consider necessary to confirm your identity and prevent fraud. This may include verifying information you provide against third party databases. Please refer to our Privacy and Cookie Policy for more information.

(c) You must not: (i) use the LOKE Take to Table Solution for any unlawful, fraudulent or abusive purpose, including placing fraudulent orders, abusing refunds or chargebacks, or manipulating a loyalty programme; (ii) create more than one account to obtain rewards or offers, or use another person’s account or payment card without authority; (iii) copy, modify, reverse engineer or decompile the LOKE Take to Table Solution, except to the extent the law allows despite this restriction; (iv) use any robot, scraper or other automated means to access or collect data from the LOKE Take to Table Solution, or interfere with its security or operation; or (v) harass, threaten or abuse the staff of a Food and Beverage Partner or Venue Partner, couriers or our staff.

7. INTELLECTUAL PROPERTY RIGHTS

(a) Except as permitted under applicable law, the User may not reproduce, distribute, adapt or publish copies of any information or material found on the LOKE Take to Table Solution (or the LOKE Take to Table Solution itself) in any form (including by e-mail or other electronic means), without LOKE’s prior written consent.

(b) All trade marks, copyright and other Intellectual Property Rights in the LOKE Take to Table Solution and the information and material contained on the Platform are owned by or licensed to LOKE, the Venue Partner or the Food and Beverage Partner. We grant you a personal, non-transferable, revocable licence to use the Platform for its intended purpose in accordance with these Terms.

(c) If you give us feedback or suggestions about the LOKE Take to Table Solution, you agree that we may use them without restriction or payment to you.

(d) If you downloaded the LOKE Take to Table Solution from the Apple App Store or Google Play, you also agree to the applicable store’s terms. These Terms are between you and LOKE only, not Apple or Google. Apple and Google have no responsibility for the LOKE Take to Table Solution, its maintenance or support, or any claim relating to it. If the LOKE Take to Table Solution fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for it (which is nil). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8. PRIVACY

(a) LOKE is a data controller of the Personal Data it collects from you through the Platform and will handle it in accordance with the UK GDPR, the Data Protection Act 2018 and the terms of LOKE’s Privacy and Cookie Policy. The Venue Partner and the Food and Beverage Partner are each separate data controllers of the Personal Data they receive about you through the Platform.

(b) LOKE, the Venue Partner and the Food and Beverage Partner (including their authorised service providers) may use data and information (including Personal Data) that you submit when registering with or using the LOKE Take to Table Solution in order to provide you with the Take to Table Solution and for the other purposes described in their respective privacy notices, including to:

(i) pass your order, seat or table location and contact details to the Food and Beverage Partner and the Venue Partner so that your order can be prepared and delivered;

(ii) send you service messages about your orders and account;

(iii) where you have agreed or where the law otherwise allows, send you marketing and personalise the offers and content shown to you; and

(iv) monitor use of the Take to Table Solution for security, fraud prevention and improvement of the service.

(c) The LOKE Take to Table Solution may log (and LOKE may have access to) information about any mobile device or computer used to access the LOKE Take to Table Solution (including the User’s IP address, operating system and browser type) and the date and time of access.

(d) We use appropriate technical and organisational measures to protect your Personal Data, but no transmission over the internet is completely secure, and you should keep your login details confidential.

9. DISCLAIMER

(a) LOKE is not the supplier of any of the goods and services advertised through the LOKE Take to Table Solution. LOKE does not moderate interaction between Food and Beverage Partners, Venue Partners and Users.

(b) The Food and Beverage Partner is entirely responsible for all goods and services advertised via the LOKE Take to Table Solution. All complaints or disputes relating to any advertised goods and services must be directed to the Food and Beverage Partner. LOKE will provide you with the contact details of a specific Food and Beverage Partner on request to support@loke.global.

(c) Representations about goods and services, including menus, prices, allergen and dietary information and availability, are based on information and material provided to LOKE by the relevant Food and Beverage Partner. For the avoidance of doubt, the User acknowledges that LOKE and the Venue Partner do not themselves make any representations, either express or implied, as to the quality, accuracy, reliability or credibility of information or material supplied or made available by third parties, including Food and Beverage Partners, on the LOKE Take to Table Solution. If you have an allergy or dietary requirement, please check with the Food and Beverage Partner directly before ordering.

(d) Any dispute between the User and the Food and Beverage Partner must be resolved by the User and the Food and Beverage Partner. LOKE and the Venue Partner will pass on your complaint to the Food and Beverage Partner if you ask, but are under no obligation to resolve the dispute.

10. LIABILITY

(a) Nothing in these Terms excludes or limits the liability of LOKE, the Venue Partner or any Food and Beverage Partner for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of England and Wales. Nothing in these Terms affects your statutory rights as a Consumer.

(b) We will supply the Take to Table Solution with reasonable care and skill. If we fail to do so, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

(c) Neither LOKE nor the Venue Partner is responsible for the goods and services supplied by a Food and Beverage Partner, for the accuracy of information a Food and Beverage Partner provides, for any failure of a Third Party Service that we do not control, or for any failure or delay in the Take to Table Solution caused by events outside our reasonable control, including failures of internet, mobile or payment networks or restrictions on movement within the Venue.

(d) The Take to Table Solution is provided for domestic and private use. If you use it for any commercial or business purpose, LOKE and the Venue Partner have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

(e) If you use the Take to Table Solution in breach of these Terms, you will be responsible for any loss or damage that LOKE, the Venue Partner or a Food and Beverage Partner suffers as a reasonably foreseeable result of that breach.

(f) The Venue Partner and each Food and Beverage Partner may enforce the provisions of these Terms that are expressed to benefit them, under the Contracts (Rights of Third Parties) Act 1999. Otherwise, no person other than you and LOKE has any right to enforce these Terms.

11. TERMINATION OF ACCESS

(a) You may stop using the Take to Table Solution and close any account at any time through the Platform or by contacting support@loke.global.

(b) LOKE may suspend or terminate the User’s access to the LOKE Take to Table Solution if the User breaches these Terms, if we reasonably suspect fraud or misuse, if the Venue Partner withdraws the Take to Table Solution from the Venue, or if we stop providing the Take to Table Solution, in which case we will give you reasonable notice where practicable.

(c) Termination does not affect any order already accepted by a Food and Beverage Partner or any rights or liabilities that have already accrued.

12. GENERAL

(a) These Terms are governed by the laws of England and Wales. You may bring legal proceedings in respect of these Terms in the courts of England and Wales. If you live in Scotland you may also bring proceedings in Scotland, and if you live in Northern Ireland you may also bring proceedings in Northern Ireland.

(b) If you have a complaint about the Take to Table Solution, please contact us at support@loke.global and we will try to resolve it with you. If we cannot resolve your complaint you may be able to use an alternative dispute resolution provider, and you remain free to bring a claim in court.

(c) LOKE accepts no liability for any failure or delay in complying with these Terms where such failure or delay is due to circumstances beyond LOKE’s reasonable control.

(d) If LOKE waives any rights available to it under these Terms on one occasion, this does not mean that those rights will be automatically waived on any other occasion.

(e) If any of these Terms, or any part of any Term, are held to be invalid, unenforceable or illegal for any reason, the remaining Terms, or part thereof, will continue in force.

(f) We may transfer our rights and obligations under these Terms to another organisation, for example if a LOKE group company takes over the provision of the Take to Table Solution; we will tell you if this happens and it will not affect your rights. You may not transfer your account or rights under these Terms to anyone else.

(g) These Terms were last updated on 11 October 2026.
